چکیده | ||
هدف اساسی نظام عدالت کیفری بیشک، تبرئه بیگناهان و کیفر مجرمان است. دستیابی به این هدف که با رعایت قواعد دادرسی عادلانه و حقوق دفاعی متهمان ممکن است، در خصوص دستهای از متهمین که به دلایل مختلفی از توانایی درک فرایند دادرسی کیفری و دنبال کردن آن عاجز بوده و متهمان آسیبپذیر خوانده میشوند، دشوارتر است. همین مساله ضرورت نگاه ویژه و افتراقی قانونگذار کیفری نسبت به آنان را نشان میدهد. در پزوهش حاضر به روش توصیفی- تحلیلی و با استفاده از منابع کتابخانهای به دنبال ارائه تعریفی روشن و قابل فهم از متهمان ناتوان و آسیبپذیر و نیز بررسی معضلات آنها در مواجهه با نظام عدالت کیفری هستیم تا به دنبال آن راهکارهای حمایتی خاص از آنها پیشنهاد شود. بررسی تطبیقی موضوع نشان میدهد، استفاده از راهکارهایی در جهت تقویت تعامل و ارتباط آنان با مراجع پلیسی و قضایی و نیز تقویت حقوق دفاعیشان میتواند کارآمد باشد. | ||
