چکیده | ||
شناخت ماهیت و ویژگیهای اصول بنیادین دادرسی کیفری با توجه به تنوع اصول و محتوای آنها و تفاسیر گوناگونی که در بستر رویکردهای مختلف نظری مطرح شده است، مستلزم شناخت مبانی مختلف این اصول است. سئوال مهم در این رابطه، این است که مهم ترین مبانی اصول بنیادین حاکم بر دادرسی های کیفری کدام است وآیا می توان مبنایی واحد برای توجیه این اصول یافت؟ افراط گرایی دیدگاه های مختلف در توجیه مبانی اصول بنیادین و توجه آن ها تنها به بخشی از واقعیات موجود موجب می گردد که نتوان به یک مبنا در توجیه اصول اکتفا کرد. این مبانی گاه جنبه اخلاقی و فلسفی به خود گرفته و توجیه خود را در رویکردهای اخلاقی – فلسفی دنبال مینماید و گاه جنبه حقوقی و اجتماعی یافته و به دنبال مشروعیت بخشی به خود از طریق مبانی حقوق بشری و یا دیدگاههای مصلحت اندیشانه یا امنیت گرایانه است. در این مقاله با رویکردی تحلیلی – توصیفی، با روش کتابخانه ای و با استفاده از ابزار فیش برداری به دنبال توجیه اصول مبانی اصول بنیادین دادرسی های کیفری است. | ||
