| چکیده | ||
| نگاه به اصل برائت حسب اینکه از منظر انسان فنومن یا نومن باشد، آثار متفاوتی خواهد داشت. آنچه در حقوق ایران مصطلح شده بیشتر اصل برائت اصولی، بهعنوان یک اصل عملی است که مجرای آن، شک در تکلیف است و در موارد تردید، باعث رهایی انسان مکلف (فنومن) از گردابِ تحیر است. اما چنانچه از دیدگاه انسان نومن به اصل برائت نگریسته شود، مبنا نه بر تکلیف که بر آزادی و برائت انسان است. برائت نومنی به تفسیرگر قانون اجازه نمیدهد حکم جزایی را توسعه دهد و مفسر در تفسیر مقررات جزایی، به مورد متیقن اکتفا میکند و نمیتواند با معیارهای ذهنی، اقدام به بسط استثنا نماید. در پژوهش حاضر، با منهج تحقیقی کیفی (رویکرد توصیفی – تحلیلی)، این فرضیه که نگاه به اصل برائت با دیدگاه انسان نومن آثار تفسیری متفاوت از اصل عملی برائت را در بردارد، تقویت گردیده است. | ||
