| چکیده | ||
| نقش پلتفرمهای تجاری فناوری اطلاعات در تغییر سبک زندگی غیرقابل انکار است. با توجه به جرایم ارتکابی در بستر اینها، تأثیر آنها بر سیاست جنایی ایران غیرقابل انکار است. با این حال به نظر میرسد سیاست جنایی فعلی کشور ایران، در مقابله با جرایم ارتکابی توسط آنان کارآمد نیست. این مقاله به روش توصیفی-تحلیلی به پاسخ به این پرسشها میپردازد که ضرورتها و بایستههای سیاستگذاری جنایی در قبال فعالیتهای مجرمانه پلتفرمهای تجاری فناوری اطلاعات چیست؟ قدرت روزافزون، سرعت رشد و سوداگری پلتفرمها، تهدید قدرت و ایدئولوژی دولتها توسط پلتفرمها و ظهور جرایم نوین در بستر پلتفرمها، از زمره علل ضرورت؛ و پیشبینی نهاد قانونی سیاستگذار، بازتعریف برخی مفاهیم حقوق کیفری سنتی، تنظیم سازوکارهای پیشگیری از جرم و پاسخگویی به آن -با رعایت حداکثر حقوق و آزادیهای بنیادین- میتواند به کارآمدسازی سیاست جنایی در این خصوص کمک کند. | ||
