| چکیده | ||
| قانون مجازات اسلامی مصوب 1392، مصادیق جرم زنای به عنف را گسترش داده است. تبصرة ۲ مادة ۲۲۴ این قانون، زنا با زن در حال بیهوشی، خواب یا مستی، زنا از طریق اغفال و فریب دختر نابالغ و زنا پس از ربایش یا تهدید زن را در حکم زنای به عنف بهشمار آورده است. پژوهش حاضر با مراجعه به یافتههای روانشناسان و مقررات سایر نظامهای حقوقی، متن این تبصره را ازنظر جامع بودن آن در پیشبینی حالتهای در حکم زنای به عنف، تحلیل کرده است. واکاوی منابع کتابخانهای نشان میدهد که وضعیتهای یادشده، تمام صورتهای تجاوز در حکم عنف را در بر نمیگیرد. بنابراین عبارت تبصره باید بهگونهای اصلاح شود که همة فروض نبود رضایت به نزدیکی را شامل شود. این بازنگری حمایت مناسبتری از قربانیان جرایم جنسی فراهم میکند و با موازین شرعی این بحث نیز سازگار است. | ||
