چکیده | ||
با گسترش تجارت جهانی و افزایش وابستگی کشورها به امنیت خطوط کشتیرانی، تهدیداتی همچون دزدی و تروریسم دریایی اهمیت مضاعفی یافتهاند. این پدیدهها که ریشه در گذشتههای دور دارند، امروزه با اشکال پیچیدهتر و ابعاد فراملی ظهور یافتهاند و نظم حقوقی بینالمللی را با چالشهایی جدی مواجه کردهاند. در این مقاله، با بهرهگیری از روش تحلیل کیفی، تلاش شده است تا نقش دولتها در مقابله با این تهدیدات و میزان انطباق آن با اصول و قواعد حقوق بینالملل بررسی شود. تمرکز اصلی بر اصولی همچون صلاحیت جهانی، همکاریهای فراملی و ضعف در ضمانت اجرای تعهدات است. یافتههای تحقیق نشان میدهند که در نبود سازوکارهای الزامآور، تعریف دقیق از تروریسم دریایی و هماهنگی حقوقی میان کشورها، مقابله مؤثر با این جرایم با موانع اساسی روبهروست. در نهایت، مقاله بر ضرورت تقویت رژیم حقوقی مقابله با جرایم دریایی، ایجاد وحدت رویه در تفسیر مفاهیم و ارتقای همکاریهای منطقهای و بینالمللی تأکید دارد. | ||
